Henry Wolf, from California, alleged four hours on the BMW in 2010 left him with an erection for two years.

He sought compensation for lost wages, medical expenses, emotional distress and ‘general damages’ from BMW and seat-maker Corbin-Pacific.

But the claim has been tossed out by the Superior Court of San Francisco, where judge James J McBride ruled the plaintiff did not present enough supporting evidence.

Seriously, I am getting sick of frivolous lawsuits.  I am glad this one was tossed out.  Suing corporations in hopes of making big bucks is a popular game in this society.  However, many people get overly creative with their claims, creating lawsuits over laughable causes.  I do believe most of these cases get thrown out.   We should pass a law that says someone or a group of someone can determine if a suit is frivolous and make the plantiff pay for all legal costs associated with the defence.

I'm of the belief that those who instigate a suit should pay *ALL* the fees if they lose. That should be the standing rule, modifiable by the judge. I think it'd be a good start.

You've already got the option to include legal fees in a settlement; it's judge's discretion to award it or not. But making this a rule would, hopefully, make a lot of lawyers bringing this frivolous stuff to court think twice.
